Establishing an NGO
Non-governmental organizations, according to GEO 26/2000 with the amendments introduced in Law no. 246/2005, are the subject of law consisting of one or more persons who, based on an agreement, share without right to reimbursement their material contribution, knowledge or work contribution for carrying out activities of general interest, community interest or, as appropriate, in their own non-patrimonial interest.

– Proof of name availability issued by the Ministry of Justice: 36 Lei.
– Legal stamp duty: 100 Lei.

– application to the Court, providing de facto and de jure statement of grounds;
– proof of having paid the legal stamp duty in the amount of 100 Lei;
– valid proof of name availability issued by the Communication and Public Relations Service of the Ministry of Justice;
– articles of incorporation and articles of association;
– proof of the association’s initial assets – 200 Lei;
– proof of the foundation’s initial assets – at least 100 times the national gross minimum wages, on the date of setting up the foundation;
– proof of the association’s registered office through a valid bailment or lease agreement and a valid Real Estate Register excerpt;
– In case the future registered office of the NGO shall be established in a condominium (block of flats), additionally, the following documents are required: the agreement of the lodgers’ association as well as the agreement of the directly affected neighbours.
– fiscal record certificates of the founding members;
– copy of the identity card of each founding member and of the censor;
– CD/DVD with the NGO’s incorporation documents in Word and PDF format.
The process of registering the company will take 20-40 business days after the date of submitting the file to the Court.
